Albron The Transferor the Employment Relationship and the Principle of Protection
Is an employee who is employed by a staff entity and seconded to
an operating company transferred by operation of law if (a part of)
the activities of the operating company are transferred to an
undertaking outside the group of companies? The European Court of
Justice has answered this question affirmatively in the Albron
judgment. In this article we will discuss this judgment and look at
the effects thereof for practice in the Netherlands, France,
England, Germany and Belgium.
