Financial supervision

With the entry into force of the Financial Services Act in 2006 and the Financial Supervision Act (Wet op het Financieel Toezicht (“Wft”)) in 2007, the separate, sectoral financial supervision laws have mostly disappeared. For the financial sector, the consequences have been considerable.


Knowledge of the Wft not only requires knowledge of the old laws and the intentions of the legislator when drafting the current law, but also knowledge of the system of the law.
The Wft and the regulations based on it are extensive and subject to regular amendment. As a result, the question of which financial rules you will currently have to comply with is not always easy to answer. But there is more to it. The rules are one thing, but what these rules mean for you in practice is quite another. The Financial Supervision Practice Group of Kennedy Van der Laan is able to assist you in this respect. For instance by making the legal rules of the game transparent for you and by assisting in their translation into practical rules, or by supporting you in the communications with the Dutch National Bank (DNB) or the Netherlands Authority for the Financial Markets (AFM).


The Financial Supervision Practice Group consists of attorneys who are experts in various fields, so that appropriate expertise is always close at hand. Not only do we have knowledge of banking, insurance and securities law, but also of, for instance, administrative law and administrative procedural law, as well as ‘general’ procedural law. So, in the unlikely event that you become involved in legal proceedings in which financial supervision rules play a role, you may also benefit from what our practice group has to offer.
